Wiped everything I could find relating to empire from the hard drive and the registry and then re-installed from local back up files. The way to fix that was doing a complete manual uninstall of the game (registry values and everything) and then doing a clean install. I used to have this problem with RTW after installing and uninstalling mods etc. So I unistalled empire and reinstalled it from local backup and it didn't fix it.
